The documentary “The Unconsulted Consultation” is an independent record of the unheard testimony of the prior consultation process implemented by the national government for the extraction of oil in ancestral territories in Pastaza and Morona Santiago.

"The Unconsulted Consultation" analyses the mechanisms used by the Ecuadorian government to impose oil activity in the territories of indigenous Amazonian peoples and communities.

The events are part of the "prior consultation" promoted by the government of Rafael Correa for the Eleventh oil round that put up for tender oil lots located in the territories of seven Amazonian nationalities in the southeastern Amazon of Ecuador.

The documentary shows that this consultation was neither free, nor prior, nor informed, as established by international law and the Ecuadorian Constitution itself.

“The Unconsulted Consultation” was presented at the Inter-American Commission on Human Rights (IACHR) in Washington on October 28 as legal evidence in the case “The Right to Prior Consultation of Indigenous Peoples in Ecuador,” a case brought by the Amazon Legal Network, the Pachamama Foundation, the Lianas Center, the Regional Institute for Human Rights (INREDH), the Human Rights Center of the Pontifical Catholic University of Ecuador, the Confederation of Indigenous Nationalities of Ecuador (CONAIE), the Confederation of Indigenous Nationalities of the Ecuadorian Amazon (CONFENIAE), and the Kichwa Indigenous People of Sarayaku, against the State of Ecuador for its failure to comply with international legal standards on prior consultation with indigenous peoples.

The documentary (21 minutes long) is the only audiovisual recording alternative to that of the Hydrocarbons Secretariat, which testifies to the irregularities of this procedure and the true position of the indigenous organizations, which is not disclosed in the official report of the prior consultation of the SHE.
